01Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the website at noirsms.com and the services offered by Noir SMS, operated by [COMPANY LEGAL NAME], registered at [REGISTERED ADDRESS] ("Noir SMS", "we", "us").
By creating an account, adding funds or using any number we provide, you ("you", "the Customer") confirm that you have read, understood and accepted these Terms, our Acceptable Use Policy and our Privacy Policy. If you do not agree, do not use the services.
02The service
Noir SMS rents temporary virtual phone numbers ("numbers") from the United States, Canada, the United Kingdom and other countries so you can receive a one-time SMS verification code (OTP) for your own accounts on third-party websites and apps.
- Each number is single-use: it is reserved for one verification on one service.
- Each number is reserved for you for 20 minutes (the "activation window").
- Numbers are receive-only. You cannot make calls or send SMS from them, and they are not meant for long-term use or account recovery.
- We do not control third-party services. A platform may reject, block or later restrict an account verified with a virtual number, and we are not responsible for those decisions.
03Your account
You must be at least 18 years old and able to form a binding contract to create an account. You agree to provide accurate information and keep it up to date.
You are responsible for keeping your password secure and for all activity under your account. We recommend enabling two-factor authentication. Tell us immediately at [SUPPORT EMAIL] if you suspect unauthorized access.
One person may not use multiple accounts to abuse promotions, referral rewards or refunds.
04Acceptable use
You may only use Noir SMS to verify accounts that belong to you and that you are entitled to create, in line with each platform's terms. Fraud, impersonation, bulk or automated account creation for abuse, spam, evading bans and any illegal activity are strictly prohibited.

05Balance, prices and payments
- Noir SMS works on a prepaid balance. The minimum top-up is $5 USD. There is no subscription and no monthly fee.
- Prices are shown in US dollars per number, vary by country and service, and are displayed before each purchase. The price at the time of purchase is the price you pay.
- Payments are processed by Stripe (credit and debit cards, and wallets such as Apple Pay or Google Pay where Stripe offers them). We never see or store your full card details.
- Your balance does not expire while your account is active. Balance is not a bank deposit, does not earn interest and cannot be transferred to other users.
- Any applicable sales tax or VAT is shown at checkout where required.
06Cancellations and refunds
- No code, no charge. If no SMS arrives within the activation window, the number expires and its price is returned to your balance automatically.
- You may cancel a number manually starting 2 minutes after purchase, as long as no SMS has been received, and the price is returned to your balance instantly.
- Once an SMS has been delivered to a number, the purchase is complete and is not refundable, even if the third-party service later rejects the code or the account.
- Unused balance may be refunded to the original payment method on request within [REFUND WINDOW, e.g. 30] days of the top-up, minus any payment processing fees, unless the account was suspended for a breach of these Terms. Bonus or promotional credit is never refundable.
- Nothing in these Terms limits any refund rights you have under the consumer laws of your country or province.
07API access
If you use the Noir SMS API, you must keep your API keys secret and you are responsible for all requests made with them. We may apply rate limits and may revoke keys used in breach of these Terms. The same prices and refund rules apply to API purchases.
08Suspension and termination
We may suspend or close your account, and withhold refunds of balance obtained or used in breach of these Terms, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law, or to protect our users, partners or infrastructure. Where appropriate we will tell you why.

09Availability and support
We aim to keep the service available 24/7, but stock of numbers changes constantly and we do not guarantee that a number will be available for every country or service at all times, or that every SMS will be delivered. Support is available at [SUPPORT EMAIL].
10Intellectual property
The Noir SMS name, logo, website and software belong to us or our licensors. Third-party names and logos shown on the site belong to their respective owners and are used only to identify compatible services; Noir SMS is not affiliated with or endorsed by them.
11Disclaimers and limitation of liability
The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 3 months before the event giving rise to the claim, and we are not liable for indirect, incidental or consequential losses, including lost accounts, profits or data.
Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer in the United Kingdom or Canada.
12Indemnity
You agree to indemnify and hold Noir SMS harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the service or your breach of these Terms or the Acceptable Use Policy, to the extent permitted by law.
13Changes to these terms
We may update these Terms from time to time. The current version is always on this page with its "last updated" date. If a change is material, we will notify you by email or in the dashboard before it takes effect. Continuing to use the service after that means you accept the new version.
14Governing law and contact
These Terms are governed by the laws of [GOVERNING LAW, e.g. the State of Delaware, USA], without regard to conflict-of-law rules. If you are a consumer in the United Kingdom or Canada, you also benefit from the mandatory protections of the law where you live and may bring claims in your local courts.
